Please read these Terms and Conditions (“Agreement”) carefully before using this website or booking any travel services with us. This Agreement constitutes a legally binding contract between you (the “Client,” “Passenger,” or “User”) and Airway Interline Services Inc. (“Company,” “we,” “us,” or “our”), an agency registered and licensed to operate in the Provinces of Ontario and British Columbia.
By accessing our website, purchasing our professional consulting services, or finalizing a booking through us, you explicitly agree to be bound by these Terms and Conditions.
- Regulatory Licenses & Compliance
We operate in strict compliance with provincial consumer protection legislations governing travel sales in Canada:
- Ontario Registration: Registered as a travel retailer with the Travel Industry Council of Ontario (TICO), Registration Number: 50018534 (Branch Licenses: 50028110, 50028111).
- British Columbia Registration: Licensed as a travel agent with Consumer Protection BC (CPBC), License Number: 89165.
Customers residing in Ontario who book directly through our Ontario registration may be protected by the Ontario Travel Industry Compensation Fund. Please note that consumer protection laws, fund eligibility, and recovery limits vary by your province of residence at the time of booking.
- Role as an Intermediary / Third-Party Suppliers
Airway Interline Services Inc. acts strictly as a sales agent and intermediary between you and third-party travel service providers, including but not limited to airlines, tour operators, wholesalers, hotels, cruise lines, and car rental agencies (each a “Supplier”).
We do not own, manage, operate, or control any of these Suppliers. When you make a booking, you are entering into a direct, legally binding contract with the respective Supplier. You are subject to, and agree to review, the specific terms, conditions, tariffs, baggage policies, and cancellation protocols of each individual Supplier involved in your itinerary. We are not responsible for a Supplier’s failure to perform or provide services.
- Pricing, All-In Mandates, and Price Increases
- All-In Pricing: All prices advertised on our website or quoted directly to Canadian residents are presented as total prices, inclusive of all non-optional fees, taxes, and levies required for the booking, in accordance with Canadian consumer laws. Provincial retail sales taxes (such as HST/GST/PST) may be broken out or shown separately where permitted by law.
- Currency: All rates are quoted in Canadian Dollars (CAD) unless explicitly stated otherwise.
- Price Adjustments & Ontario Statutory 7% Rule: Prices are subject to change without notice due to factors beyond our control, including fuel surcharges, currency fluctuations, or Supplier increases.
- Statutory Right: In accordance with Ontario travel regulations, if the total price of your travel services increases by more than seven percent (7%) after a deposit has been paid (except where the increase is a direct result of federal or provincial government tax hikes), you have the right to cancel the booking and receive a full, immediate refund of all monies paid to Airway Interline Services Inc.
- Professional Fees, Payments, and Cancellations
- Professional Service Fees: Any planning, consulting, concierge, change, or administrative fees charged directly by our agency are 100% non-refundable under any circumstances, as they represent compensation for professional services rendered.
- Deposits and Final Payment: To secure a booking, required deposits must be paid at the time of reservation. Final balances must be paid in full by the deadline specified in your invoice (typically 45 to 60 days prior to departure). Failure to pay the final balance by the deadline will result in automatic cancellation of your itinerary and forfeiture of your deposit under Supplier terms.
- Cancellations & Changes: All requests for booking modifications or cancellations must be submitted to us in writing. In addition to any non-refundable fees charged by our agency, your booking will be subject to the strict cancellation schedules and penalties imposed by the respective Suppliers.
- Mandatory Travel Insurance Disclosure
IMPORTANT CONSUMER DISCLOSURE: In compliance with provincial travel industry regulations, Airway Interline Services Inc. strongly recommends and explicitly offers comprehensive travel insurance to all clients at the time of inquiry and booking.
Travel insurance can protect you against unexpected financial losses due to trip cancellations, trip interruptions, flight delays, lost baggage, emergency medical expenses, and emergency evacuation or repatriation.
- By finalizing a booking with us without purchasing an insurance policy through our agency, you acknowledge that you have been formally offered travel insurance and have consciously chosen to decline coverage or have secured alternative coverage independently.
- You assume all financial risks associated with traveling uninsured, and acknowledge that Airway Interline Services Inc. will not be held liable for any out-of-pocket costs resulting from medical emergencies or trip cancellations.
- Passports, Visas, and Entry Requirements
It is the sole legal responsibility of the Passenger to ensure they possess valid, lawful travel documents required for entry, transit, or exit across international borders.
- Passports: Every traveler must hold a valid passport. Most destination countries strictly require that your passport be valid for at least six (6) months beyond your scheduled return date.
- Visas & Electronic Authorizations: You are responsible for obtaining all necessary visas, transit visas, Electronic Travel Authorizations (e.g., eTA, ESTA, ETIAS), and health/vaccination documentations.
- Denial of Entry: We accept zero liability if you are denied boarding by an airline or refused entry at any border checkpoint due to invalid documentation, historical criminal records, or non-compliance with local immigration laws.
- Force Majeure & Limitation of Liability
- Force Majeure: Airway Interline Services Inc. will not be liable, nor be deemed in breach of this Agreement, for any delay, cancellation, itinerary alteration, injury, or financial loss caused by a “Force Majeure” event. This includes, but is not limited to: acts of God, natural disasters, severe weather, strikes, government mandates, border closures, pandemics, civil unrest, wars, terrorism, or bankruptcy/insolvency of a Supplier.
- Limitation of Liability: To the maximum extent permitted by applicable provincial law, the Company’s total aggregate liability arising out of or related to your booking or use of this website shall be strictly limited to the total amount of professional service fees paid directly to Airway Interline Services Inc. for the transaction in question. We are never liable for indirect, incidental, punitive, or consequential damages.
- Governing Law & Dispute Resolution
This website, your booking, and this Agreement shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any legal dispute, action, or proceeding arising directly or indirectly out of this Agreement shall be brought exclusively before the courts located in the City of Toronto, Ontario, and you hereby irrevocably consent to the exclusive jurisdiction of such courts.
